Nest Collaborative, LLC
Nest Collaborative and its affiliated Gorman and Associates, LLC (collectively the “Companies,” “we” or “us”) are committed to respecting and protecting your private information.
Personally identifiable information (PII) is any information such as a first and last name, email, home or business address and phone number, that can be used to identify a person. At present, PII is only collected directly by the Companies when you submit your PII to us through form submission or email communication.
Typically, visitors to our site can browse without giving us any PII directly. Any PII that is collected via voluntary form submission is received by email, which has been sent by you, the user. Information obtained from our online forms is considered protected health information (PHI) and thus protected as described in our HIPAA Notice of Privacy Practices (NPP). Conflicts arising between this notice and the NPP will be resolved in favor of the NPP. Your right to notice of the use and disclosure of your PHI made by the Companies, and our legal duties regarding it, can also be reviewed in the NPP. We otherwise do not compile PII from users commenting on the site or asking questions.
A “cookie” is a small data file that websites can write to be stored onto your hard drive; they store basic information like user IDs. However the only PII cookies can contain is information supplied by the user himself for that particular site, and not information otherwise stored elsewhere on your hard drive or from other websites.
You can set your browser to warn you prior to accepting cookies and/or reject them entirely. At this time, you do not need to accept cookies in order to use our site.
We collect IP (Internet Protocol) address from our users for the purpose of traffic analysis. IP addresses are sets of assigned numbers given to a distinct internet connection. They are not unique to a computer and cannot identify a user’s identity. They do identify geographic locations and other information specifics such as Internet Service Providers, operating systems and web browsers in use. While we may log the above information in addition to your other web-browsing patterns, we do not sell this information or share it with anyone. We use it simply to administer and improve our service with customizations and enhancements developed based on the above analyzed data.
If using a mobile device to access our website, we may collect information sent by your device, like its personal identifier, user settings and operating system, and user patterns. This may include user location if you have enabled locations services on your device. If you prefer not to share this information with us, you can disable this feature on your device.
Information Sharing and Disclosure
PII is not shared without your expressed permission except as noted below.
Information Shared With Service Providers
We engage with third-party services to administer our Service who have access to your PII and PHI for the sole purpose of performing the Service on our behalf. They are under direct obligation not to disclose or use your PII or PHI for any other purpose.
Our website may contain links to third-party sites not owned or operated by the Company. We encourage you to learn about their privacy policies as we hold no responsibility for their website’s content, privacy, or security.
For the purposes of research, demographic analysis and quality improvement processes, we may share your non-identifying (non-PII and non-PHI) information with third parties.
Information Disclosed Under Business Transactions
In the event of a company merger, acquisition or asset sale, or other asset relinquishment, your PII may be disclosed or transferred as a business asset to the acquiring party in connection with the transaction.
In Protection of the Companies and Others
The Companies will cooperate lawfully with government and law authorities, or private parties to comply with the law. We shall disclose any information we believe necessary and appropriate, at our discretion if deemed required to a) enforce our Terms of Service, b) respond to a legal process, c) protect the property, rights and safety of the Company, its users, the public in general and our business associates, d) to stop any illegal activity and e) as required by any applicable local, state or federal laws.
